Devu Chodankar Issue – Part 2


Some friends from Goa who are closer to facts told me that Devu’s account was actually being handled by an independent MLA’s IITian relative and not Devu himself. In fact now that the matter has reached the court, this MLA and his IITian relative are more scared than Devu himself and are trying to get some kind of political cover by bringing media attention to the whole issue by blaming Modi and others.

Another person familiar with legal matters brought to my notice that even though 153A and 295A are not so relevant here the more relevant IPC was 505B 

Whoever makes, publishes or circulates any statement, rumour or report,—

with intent to cause, or which is likely to cause, fear or alarm to the public, or to any section of the public whereby any person may be induced to commit an offence against the State or against the public tranquility; 

This section seems both reasonable and relevant to Devu’s case who was indeed spreading rumors. Of course it is questionable whether this would have actually lead to any person acting against the state.

  1. There is some totally incorrect information regarding my case in two of your blogs.
    Although your take on legal issues regarding the case is impressive, there are a few occasions where you have fallen prey to the government propaganda.
    Someday I would like to respond with a blog clarifying it all.
